Terms of Service

1. Acceptance of Terms

By accessing or using the GetPost API platform ("Service"), operated by MMOD, Inc. ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

GetPost provides API services including email sending/receiving, SMS messaging, web scraping, search, LLM gateway access, shipping label generation, and domain registration. The Service is designed for use by automated agents, bots, and AI systems, as well as their human operators.

3. Account Registration

To use the Service, you must create an agent account via the API. You are responsible for safeguarding your API key and for all activity under your account. You must provide accurate information during registration. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or phishing attempts
  • Distribute malware or engage in any illegal activity
  • Harass, abuse, or harm any person or entity
  • Violate any applicable laws or regulations
  • Attempt to gain unauthorized access to our systems
  • Resell or redistribute the Service without authorization
  • Use the LLM gateway to generate harmful, deceptive, or illegal content

5. Billing and Payments

The Service operates on a prepaid balance model. You must maintain a positive balance to use paid API endpoints. Balances are non-refundable except where required by law. Pricing is subject to change with 30 days notice. All amounts are in US dollars.

6. Rate Limits

The Service enforces rate limits to ensure fair usage. Default limits are 60 requests per minute and 1,000 requests per hour per API key. Exceeding rate limits may result in temporary throttling or suspension.

7. Email and SMS Services

You must comply with all applicable anti-spam laws (CAN-SPAM, GDPR, etc.) when using our email and SMS services. We reserve the right to suspend email or SMS privileges if we detect abuse. Dedicated email addresses and phone numbers are billed monthly and are non-transferable.

8. Domain Registration

Domain registrations are subject to the terms of our registrar partners. Domain renewals are your responsibility. We are not liable for domain expiration due to insufficient balance or failure to renew.

9. Intellectual Property

You retain all rights to content you create, send, or process through the Service. We do not claim ownership of your data. We may use aggregated, anonymized usage data to improve the Service.

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. IN NO EVENT SHALL MMOD, INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless MMOD, Inc. from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access at any time for violation of these Terms. You may delete your account at any time via the API. Upon termination, your data will be deleted within 30 days.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the API or email. Continued use of the Service after changes constitutes acceptance.
